Terms of Service
Eighteen O Nine Limited ("Enju Ya", "we", "us"), a company registered in Kenya, operates Enju Ya at enjuya.com. Our company website is 1809ltd.co.ke. Contact: support@example.com.
In short. Enju Ya is a private place where your family documents itself. You own what you add. We host it, keep it private to your family, show no advertising, and let you take all of it out at any time. You must have the right to record the living relatives you add. Accounts are for people aged 13 and over, with a parent's or guardian's consent under 18. The free plan is permanent; the Heirloom Pass is paid yearly. We are not liable for indirect losses, and we cannot promise the Service is never down. These Terms are governed by the law of Kenya, and your local consumer rights are not taken away.
1. The agreement
1.1 These Terms are a contract between you and Eighteen O Nine Limited for the use of enjuya.com and the Enju Ya service (the "Service"). By creating an account, or by using an account you accepted an invitation into, you agree to them. We record which version you accepted, when, and from which internet address.
1.2 The Privacy Policy, the Cookie Notice and the Refund and Cancellation Policy are part of these Terms.
1.3 If you buy the Heirloom Pass by card, the purchase itself is made from Paddle.com Market Ltd or its affiliate as reseller and Merchant of Record, under Paddle's Checkout Buyer Terms, which you accept at checkout. These Terms govern the Service; Paddle's terms govern the payment.
2. Eligibility
2.1 You must be at least 13 years old to hold an account. If you are under 18, or under the age of digital consent where you live, your account is created only with the consent of a parent or guardian: at signup you name them, we email them a link, and your account stays limited until they confirm. We record that consent. Younger relatives may be recorded in a family tree by an adult who has the authority to do so (clause 6).
2.2 You must give a working email address or phone number and keep it current. Some actions — creating a family workspace, inviting relatives, buying a plan — require a confirmed email address.
2.3 You may not use the Service if the law of your country forbids it, or if we have previously closed an account of yours for breach of these Terms.
3. Accounts and security
3.1 Keep your password private. You are responsible for what is done with your account until you tell us it has been compromised at support@example.com.
3.2 We offer two-factor authentication and recommend you turn it on. Sessions last up to 30 days and can be ended by signing out.
3.3 We may suspend an account that we reasonably believe is compromised, and we will tell you how to recover it.
4. Workspaces, custodians and members
4.1 A workspace is one family's private archive. The person who creates it is its custodian and holds the authority over it: sharing, exporting, plans, succession and deletion. A workspace has exactly one custodian.
4.2 The custodian may invite relatives by sharing an invitation link bound to a specific person in the tree. Whoever accepts the link becomes a member with the role offered (admin, branch editor, contributor or viewer). Invitation links expire after 14 days. Share invitation links only with the person they are for: anyone holding the link can accept it.
4.3 Members see what their role allows. Inside a workspace every member can see every person unless the custodian or an admin has restricted a person with a sensitivity flag or converted them to a placeholder. Treat what you see as the family's confidence.
4.4 Members may be removed by the custodian. A member may leave a workspace at any time; the family keeps the record of that person in its tree.
4.5 Successors. A custodian may name successors. If a custodian is reported to have died, or has not signed in for 365 days, custodianship passes to the named successor (or, if none is named, to the longest-standing admin) after notice periods totalling about 60 days, during which the custodian can stop the transfer simply by signing in. We email the custodian and the successor at each step. This exists so that a family's archive outlives the person who started it; by naming a successor you agree to it.
5. Your content
5.1 You own it. Everything your family adds — names, dates, stories, photos, recordings, documents — is yours. We claim no ownership.
5.2 You give us a licence. So that we can run the Service you grant Eighteen O Nine Limited a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, derive relationships from, render, print, back up and transmit your content, only to provide the Service to your family, to the people you share with, and as the law requires. The licence ends when the content is deleted, except for copies kept for disaster recovery for up to 30 days and records we must keep by law.
5.3 You are responsible for it. You confirm that you have the right to add what you add, including photographs and recordings of other people, and that it does not infringe anyone's copyright, privacy or other rights, and is not unlawful, defamatory or harassing.
5.4 Accuracy. The Service organises what your family records; it does not verify it. Relationships it derives (half-siblings, co-wives, cousins) and inconsistencies it flags are calculated from your entries and are labelled as such. Disputed facts are kept side by side, attributed, and never silently erased; the custodian chooses what is shown by default. We make no promise that any record or derived relationship is correct.
5.5 Export. You can export your family's data at any time, on any plan: the tree as GEDCOM (never watermarked), and the full archive with stories, events, photos and recordings. After a workspace is deleted, export remains available to the custodian for 30 days.
6. The people in your tree
6.1 A family tree is made of other people's personal information, much of it sensitive under the laws of Kenya and elsewhere (family relationships, ethnicity and clan, religion, adoption, parentage). When you record a living person, you confirm that you are entitled to do so: you are that person, or you are their parent or guardian, or you have their permission, or you are recording facts about your own family that you are entitled to record under the law that applies to you.
6.2 You are responsible for how your family uses what is recorded. We provide the tools for privacy — restricted visibility, sensitivity flags, placeholders, approvals — and you are responsible for using them for relatives who want them.
6.3 A person who is recorded in a tree and is not a member may contact us at support@example.com to ask what is held about them, to object, or to be removed. We will tell the custodian, and where the law requires it we will restrict or erase the person's details ourselves. The node stays in the tree so the family's structure survives; the details do not.
6.4 Children may be recorded only by a parent or guardian, or with a parent's or guardian's consent, and never with more detail than the family needs.
7. Acceptable use
You may not use the Service to: harass, threaten or defame anyone; publish private information about a person to harm them; upload malware or content that is unlawful where you or we are; attempt to access another family's workspace or any data not yours; scrape, resell or mirror the Service; circumvent plan limits, rate limits or security measures; or use the Service for direct marketing or to build a database of people who are not your family. We may remove content or suspend accounts for breach, and will tell you why unless the law prevents it.
8. Plans, billing and renewal
8.1 Free plan. Free, permanent, with limits on the number of people and voice recordings and a watermark on the printed tree. The limits that applied when your family was created are kept.
8.2 Heirloom Pass. USD 27 per year for the whole family; the current price is always shown before you pay. What it includes is listed on the pricing page.
8.3 Paying by card (through Paddle): the Pass renews automatically every year at the then-current price, charged to your card by Paddle. We email you about seven days before each renewal. Cancel any time from Plan & data or through Paddle's portal; your Pass runs to the end of the paid year.
8.4 Paying by M-Pesa: one payment covers one year and does not renew by itself. We email you about 14 days before the year ends and show a renewal button; renewing early does not shorten anything — the new year starts when the current one ends.
8.5 Prices are quoted in USD. M-Pesa payments are converted to KES at the rate shown before you approve the prompt. Paddle adds or includes the tax of your country as the law requires, and issues the receipt.
8.6 Price changes apply from your next renewal; we will tell you before a renewal at a new price.
8.7 Non-payment. If a year ends unpaid, your family keeps the Pass for 14 days' grace, then returns to the free plan with its limits. Nothing is deleted — people, photos, recordings and stories stay; you only cannot add beyond the free limits until you renew.
8.8 Refunds are governed by the Refund and Cancellation Policy.
8.9 Coupons are one per family, apply to the purchase they are entered on, and do not carry to renewals unless the coupon says so.
9. Our service and its limits
9.1 We provide the Service "as is" and "as available". We will use reasonable skill and care, but we do not promise that it will be uninterrupted or error-free, that files will never be lost, or that a derived relationship is correct. Keep your own copies: export is free and always available.
9.2 We may change the Service, add or remove features, and do maintenance. We will not reduce what a paid Pass includes during a paid year without a refund of the remaining period.
9.3 The Service depends on third parties (payment providers, hosting, email, mobile money). We are not responsible for their failures, but we will tell you when they affect you and work around them where we can.
10. Privacy and security
10.1 The Privacy Policy explains what we collect and why. We never sell personal information, show no advertising anywhere on enjuya.com or in the Service, use no advertising trackers, and never make any family's data public.
10.2 We take appropriate technical and organisational measures to protect your data, summarised on the Security page. No system is perfectly secure. If a breach puts your data at real risk we will tell you in writing without undue delay and notify the regulator within 72 hours of becoming aware, as the law requires.
11. Our intellectual property
The Service, its software, designs, tree layouts and the name Enju Ya belong to Eighteen O Nine Limited or its licensors. You may use them only as part of the Service. Printed trees and exports you produce from your own content are yours. If you give us feedback we may use it without obligation.
12. Suspension and termination
12.1 You may close your account at any time from Security. It is removed after 30 days; signing in before then cancels the request. A custodian may delete a workspace; after a 30-day grace period in which it can be restored and exported, the family's people, relationships, stories, photos and recordings are permanently deleted, except invoices and payment records we must keep by law, the change log described in the Privacy Policy, and copies kept for disaster recovery for up to 30 days.
12.2 We may suspend or close an account or workspace for serious or repeated breach of these Terms, for a legal requirement, or if the Service is discontinued — in the last case with at least 90 days' notice and export available throughout.
12.3 Clauses that by their nature survive (content licence for retained copies, liability, governing law) survive termination.
13. Liability
13.1 Nothing in these Terms limits liability that cannot be limited by law — including for death or personal injury caused by negligence, fraud, or your statutory consumer rights.
13.2 Subject to 13.1, we are not liable for indirect or consequential loss, loss of data that you could have exported, loss of profit, or losses caused by third parties or by your breach of these Terms.
13.3 Subject to 13.1, our total liability to you in any 12-month period is limited to the amount you paid us in that period, or USD 50 if you paid nothing.
13.4 You will compensate us for claims by third parties arising from content you added in breach of clause 5 or 6, to the extent the law allows such an indemnity from a consumer.
14. Changes to these Terms
We may change these Terms. For material changes we will tell you by email or in the Service at least 14 days before they take effect and ask you to accept the new version; if you do not, you may close your account and, for a paid Pass, receive a pro-rata refund of the remaining period.
15. Governing law and disputes
15.1 These Terms are governed by the law of Kenya. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and nothing here deprives you of them.
15.2 Please contact us first at support@example.com; we reply within 48 working hours and most issues are solved that way. Otherwise disputes go to the courts of Kenya, unless your local consumer law gives you the right to sue where you live. For card purchases, Paddle's Buyer Terms apply to the payment and complaints about it go to Paddle.
15.3 If any clause is unenforceable the rest remain.
